Jail time ordered for theft from employer

A Marietta man was sentenced to 60 days in jail Thursday for stealing $2,000 from Marietta Polaris over a two-month period last year.

Ethan Ash, 29, of 1395 Gilman Ave., Marietta, was also ordered to pay a restitution of $2,000 to the business, where he was employed during the theft.

“Over two months he stole money periodically from the dealership,” said Washington County Prosecutor Kevin Rings.

Ash was given three years of community control once he finishes serving his jail time.

Rings argued that Ash should only have two years to pay back the restitution, rather than three.

“Well, $2,000 isn’t a large amount to pay back so I ask that he has two years to pay that back,” he said. “There’s no motivation there for him to pay that back because it’s such a long time.”

Ash’s defense attorney Ray Smith disagreed.

“He’s not working and he’s going to jail,” he said. “I think three years seems fair.”

Washington County Common Pleas Court Judge Mark Kerenyi said they will keep the state’s recommendation of two years.

“If he’s working during his community control and making an attempt to pay the restitution back then the court will take that into consideration if he can’t pay it back in the allotted time,” he said. “If he isn’t making any attempt then that will be considered a violation of parole.”

Ash pleaded guilty to theft, a fifth-degree felony, on Jan. 27. The maximum sentence possible was one year in jail and up to a $2,500 fine.

Kerenyi allowed Ash two days of credit for time served prior to sentencing.
