Man’s arrest involves child porn

The brother of a Beverly man sentenced to 44 years in prison for sexually abusing area children has been arrested for possessing pornographic photographs of an underage girl.

Roy G. Delancey, 48, of 5700 Buchanan Road, Waterford, was arrested Friday for illegal use of a minor in nudity oriented material, a fifth-degree felony. He was also charged with possession of drugs (a small quantity of marijuana that was found in his vehicle), a minor misdemeanor.

Delancey’s arrest comes nearly two years after his brother, Rodney Delancey, 56, received his sentence for raping at least six area children, mostly young boys.

Rodney pleaded guilty in December 2010 to six counts of first-degree felony rape, three counts of second-degree felony illegal use of a minor in nudity-oriented material, two counts of third-degree unlawful sexual conduct with a minor and one count of second-degree felony kidnapping.

The photographs found with Roy Delancey Friday are believed to have come from Rodney Delancey’s home.

“A couple years ago, when we went to execute a search warrant at his brother’s house, some family members knew we were coming. Prior to us arriving there were some records that were being destroyed,” said Washington County Sheriff Larry Mincks.

Roy and his mother, Irene Faye Delancey, were both indicted in July for a third-degree felony count of tampering with evidence related to the incident. Those cases are both scheduled for trial within the next month, said Mincks.

Officers came upon Roy’s vehicle Friday following a report from a relative that Roy was in possession of marijuana, said Mincks.

Roy approached the officers and told them he believed someone had planted something in his vehicle, said Mincks.

Inspection of the vehicle turned up an envelope containing numerous photographs of an underage girl engaging in sexual acts with either one or two adult males, he said.

“I think that the envelope had been in there quite some time. We think he knew it was there, but maybe had forgotten about it,” said Mincks.

Upon further questioning, Delancey admitted the envelope and photos had been taken from his brother’s trailer with the intent of destroying them prior to the execution of a search warrant in Rodney’s 2010-11 molestation case, said Mincks.

“We identified the female who said ‘Yes that’s me, and, yes, I was underage at the time’,” he added.

The girl, who was 17 at the time the photographs were taken, confirmed they were taken by Rodney without her permission, prior to his 2011 conviction, said Mincks.

The adult male or males in the photograph have not yet been identified, but the victim is cooperating with the investigation, he added.

Further charges relating to the photographs are possible, said Mincks.

Delancey remained in the Washington County Jail Monday in lieu of $5,000 bond.
