Not guilty plea from accused rapist

Donald Barth, 56, a Marietta man accused of two counts of rape, two counts of kidnapping, two counts of impersonating a peace officer and one count of possessing criminal equipment, pleaded not guilty to all charges at an arraignment Tuesday morning in Washington County Commons Pleas Court.
Barth made his first appearance Friday but his attorney, Rolf Baumgartel, was not available to be present and the arraignment was continued to Tuesday.
Judge Mark Kerenyi continued Barth’s bail of $1 million, with no objections from either Baumgartel or prosecuting attorney Kevin Rings.
Barth is accused of twice luring boys into secluded areas under the pretense of being a law enforcement official doing a search, then forcing sexual acts on them.
Kerenyi set an initial pre-trial hearing for 1 p.m. Sept. 10, a final pre-trial hearing for 10:30 a.m. Sept. 28 and a jury trial for 9 a.m. Oct. 9.
