One would think that the prosecutor should know that out of state blood work for alcohol levels is not admissible in Ohio. Instead, a worthless indictment was pursued, and valuable court time was wasted. This foolishness also caused undue stress to the family who was injured.

Belpre, OH is part of Washington County, not Parkersburg, WV. I imagine it was obvious that this man was intoxicated so in situations like this it would make sense for the EMT to draw blood in the presence of an officer.

@asknot....98 days! He has a credit of 22 days. Just how can they suspend ones drivers license, when they don't have a valid license? Plus since he's in need of surgery.....his sentence will probably be delayed. Which enables him to continue to drink-n-drive!

He only got 60 days. the 2 sentences are running concurrently, not consecutively.

What a stupid law...referring to out-of-state blood testing not being admissible. WTH isn't there a reciprocity clause at least for border towns. Shouldn't EMT's be aware of this law also??

Terrible law, can't believe a man with .354 BAC & no valid license does not get arrested for felony charges that include drunk driving. This loser should be the poster child for changing this dumb law.

 McPherson was indicted again in April, this time on the fourth-degree felony charges that allowed for the admission of the blood work.

Soooo, why wasn't he charged with OVI and vehicular assault??...how long before he breaks his community control?, 3 yrs. Is a long time for some...
