Commissioners say county can’t afford to comply with state accessibility laws

Commissioner Sam Cook said the county simply does not have the money to devote to upgrading the polling places. Commissioner John Grimes agreed.
“We have a responsibility to protect the citizens and their money,” Cook told members of the county board of elections. “And this is just more spending of money. If they come and cite you, we will answer the citation.”
Federal law mandates that all polling places comply with the Americans with Disabilities Act and state statutes.
Tara Hupp, deputy director of the elections board, said that they are in compliance with ADA, but not with the Ohio Revised Code.
“If there is only one building in the township (where you can have a polling place), what are you supposed to do?” she said.
Peggy Byers, director of the elections board, said there has been some insinuation from the secretary of state’s office that they will be fined if they do not start to comply.
Commissioner Larry Steinel disagreed with Cook and Grimes. He said his son, who relies on a wheelchair, was not able to enter his polling place at St. Bernard’s Catholic Church in Beverly. He had voted absentee prior to Election Day.
Byers said the wheelchair ramp at the church is too steep according to state code.
“Even with an electric chair, he was not able to get up that ramp,” Steinel said.
At their regular meeting Wednesday, election board member Tom Cox said roughly 90 percent of the county’s polling places did not meet accessibility requirements.
The commissioners also discussed the courthouse cafe operated by WASCO Inc. Several tables were recently set up outside the establishment, and Ann Block, the regional liaison from the secretary of state’s office, told the election board that could violate a state statute which bans loitering or congregating outside a polling place.
In the 35 days prior to Election Day, the election board is considered a polling place because voters are allowed to cast early ballots there. Hupp said the law is intended to keep voters from being unduly influenced by outside sources.
Cook said the solution they favor is removing the tables from the ground floor of the courthouse during election season, but they would discuss the issue with WASCO before they made a decision.

Politicians can always find money when it is for something they want. If they don't want it, the money is not there.

Why it is just NOW a problem after all the years of voting? What may end up happening is a reduced number of polling places so that the buildings that ARE used can comply. Is that what everyone wants?

Isn't Mr. Grimes on his way out of the Commissioner's office ???? Wonder how that could be .... Maybe he would have been re-elected if the disabled people would have been able to get in to vote .... Probably NOT, but, Maybe !!!!!

They don't have the money for this but they have funds available to send to the air show in WV. Makes you wonder.

The commissioners can't win. No matter what they do, they are criticized. They are on a budget - it is not like the federal government that can operate on a deficit or take from social security. If the money isn't there, it isn't there. While I sympathize with those who may have difficulty getting into polling places, there is nothing stopping anyone who wants to vote to do so by absentee ballot. I doubt that those complaining about the commissioners would be willing to dish out the money themselves ala tax or fee increases to pay for ADA compliance. The government has too many regulations, and not just on individuals.

Smart thinking by the commissioners. Instead of spending money to make sure disabled persons are afforded the opportunity to vote in person, they will wait to be fined. Then, they will have to spend money on making the improvements anyway but will make them on a shorter timeframe and pay a fine on top of it. Good thinking, Commissioners, good thinking.

As Chairman of our Board of Elections (Auglaize County), I understand the Commissioner's thoughts. We have been "advised" by ADA rep that a newly built (to state & Federal Codes)nursing home addition where we house one of our polling places does not comply because the handicap signs are not up high enough and do not state a fine of $250 for violators. Also, they suggest that we have poll workers police the lot now and then for offenders! This is beyond ridiculous in my opinion.

You better be finding some way to get the money! Did the commissioners not read the story about the Marietta Municipal Court? All it will take is one lawsuit to be filed and they will be correcting these problems and be fined. Why do people in the Mid-Ohio Valley think that laws don’t apply to them? Will the commissioners accept this reply from the next person that gets a speeding ticket? Shame on Mr. Grimes and Mr. Cook!
