Lowell man gets 16 months in prison
By Brad Bauer, bbauer@mariettatimes.comA Lowell man who admitted to sexually molesting a co-worker's 12-year-old daughter was sentenced Tuesday to 16 months in prison.
Assistant Washington County Prosecutor Kevin Rings said Anthony Williams, 34, was staying at a Devola residence with two individuals he worked with when he entered the child's bedroom around 5 a.m. May 17.
"She was asleep and awakened by Williams sitting on the edge of her bed," Rings said.
The child ran from the room, but it wasn't before Williams had inappropriately touched her, Rings said.
Williams made no statement at his sentencing, held before Judge Susan Boyer in Washington County Common Pleas Court.
Williams first denied any wrongdoing, but later admitted to the action, according to police. He has been held in the Washington County Jail on $15,000 bond since his May 29 arrest.
Williams agreed to plead guilty July 2 to fourth-degree felony gross sexual imposition. Rings said he could have charged Williams with a third-degree felony.
"After speaking with the child's parents, we agreed a quick resolution was best in this case," Rings said. "(Williams) agreed to plead to a bill of information, which avoided a preliminary hearing, grand jury and trial. It also keeps (the victim) off the witness stand, which is important."
A third-degree felony is punishable by up to five years in prison. On the fourth-degree felony conviction, Williams had faced up to 18 months in prison.
Boyer also designated Williams a Tier 1 sex offender. He will be required to report his address and place of employment with the local sheriff's office for 15 years after prison.

Why are you giving Boyer such a hard time? If you were to ever have to be in front of her, I bet that all of you would want her to give you as little time as possible. Be glad that she is a fair judge and take everything into consideration before passing down a sentence.

I guess that you people just dont read the article before you open you pie hole. The article read that the prosecuter lowered the charges, not the judge. It said that the charge he plead guilty to carried an 18 month sentence. Do you think that the 2 months that was taken off is the key to his rehabilitation? Who you need to look at is the kid from Belpre that they are reporting about. He got 3 days for having sex with a minor. Now he has been arrested again.

reallydisturbed...i agree 16 months is NOT long enough.. and yes chances are he wont be rehabilitated in that time and he probably will reoffend and this probably isnt the first time he offended (jsut the first time he got caught) I hope that on his probabtion terms there is something about him having to seek help, some serious community service and a very long probation and strict restrictions.

On paper, the judge can do almost anything. In practice, great deference is given to the parent's wishes. If Boyer had acted on her own, you would have cried that she was an activist judge who went against the wishes of the child's own parents and called it another case of the government interfering in a family's private business.

Judge Boyer isn't in the habit of making her own decisions. She takes the easy way out and takes whatever is presented and says "yeah, that's my decision".

What would really be great is if they could use videotaped testomony so the victum would only have to give her statement once nad it could be admitted into court. 16 months isn't enough BUT its better than nothing. But i see her parents reasoning, they are trying to protect her from even more trauma. And helping her to heal adn move on without more trama is the number 1 priority in this situation. one a side note: Hopefully they can get her the mental help she needs to make it threw this, of course a vote for the mental health levy would help her or other like her out in the futrure.

The judge's hands are NEVER tied--a judge always has the discretion of sentencing as he or she sees fit--within the sentencing guildelines, of course. The judge can take into consideration the recommendation of the State and whatever deal is presented to the court, however, sentencing is ALWAYS at the discretion of the judge.

16 months was the result of a plea deal between the child's parents and the prosecutor. Boyer's hands were tied and could only put it on the record.
