Fleming man sentenced to 19 years in prison
A Fleming man was sentenced to 19 years in prison Monday for sex crimes against three young siblings.
Kyle Palmer, 32, of 752 Christy Road, pleaded guilty to six counts of gross sexual imposition of minors under 13 years of age, and one count of sexual battery in loco parentis–all third-degree felonies.
“Some of the sentences ran concurrently to other consecutive ones, but it’s 19 years total,” explained Washington County Assistant Prosecutor David Silwani. “The state asked for 22 (the maximum available time with the plea), and (defense attorney) Rolf (Baumgartel) asked for 16, which was the minimum which Palmer could have served with the plea agreement.”
Silwani said as part of the plea agreement two first-degree felony counts of rape were dismissed as were three more counts of sexual battery and one count of tampering with evidence.
Palmer acted as a parent to the three victims, with the abuse starting before they moved to Washington County.
“But we focused the charges on what occurred here over the last three years,” said Silwani. “The reason (all of the gross sexual imposition charges) were F-3 is because two of the victims were under the age of 13. Then the sexual battery was in loco parentis, meaning he was serving in the role of a parent.”
The plea and sentencing occurred before Retired Appointed Washington County Common Pleas Judge Randall Burnworth at the time of a previously scheduled rape shield hearing.
Palmer did not speak at the hearing, and his attorney did not return a request for comment, but the victims’ mother did speak at the hearing.
“Mr. Palmer knew that I had just previously gone through the same case with my ex-husband, my children’s biological father, and I don’t understand how he could still continue to do what he did to my three daughters,” she said. “Things have not been the same since all of this came out in September. I’ve had my daughter run away from me, my twins (have) been arguing a lot. My son looked up to him as a role model and his grades have (plummeted). Everything’s changed.”
The father of the girls remains behind bars.
Palmer was indicted in September.
“I trusted him with all my heart, I left him home with my kids when I worked nights,” the children’s mother said. “And I just don’t understand why he would do this.”
Palmer has remained in custody of the Washington County Jail since his arrest, earning 207 days of jail time credit toward his sentence.
“He’ll be a Tier III sex offender, which means every 90 days (he’ll have to report his address to the local county sheriff’s office) for life,” said Silwani.
Tier III is the most strict registration requirement in the state of Ohio.
According to the Washington County Sheriff’s Office, rape, sexual battery, aggravated murder with a sexual motivation, murder with a sexual motivation, unlawful death with a sexual motivation, kidnapping of a minor to engage in sexual activity, gross sexual imposition, kidnapping of a minor and felonious assault with a sexual motivation all fall under this tier.
