Prison sentence ordered for burglary
A West Virginia man was sentenced to 24 months in prison and three years of post-release control Thursday for a burglary involving another man and a woman.
Jeremy S. Russell, 39, of 1607 Bigley Ave., Charleston, was involved in a home burglary with Kierston L. Holbrooks-Mick, 26, of 1504 Covert St., Parkersburg, and Christopher M. Wolfe, 39, of 1323 40th St., Parkersburg, this summer.
Russell and Wolfe reportedly broke into Holbrooks-Mick’s home after Holbrooks-Mick called and texted her mother to find out if her parents would be home.
Russell was sentenced in Washington County Common Pleas Court for one third-degree felony count of burglary and credited with 100 days of time already served, reducing his remaining sentence to approximately 21 months.
The maximum sentence he faced was 36 months in prison.
“(The prison sentence) is based on his prior record,” explained Defense Attorney Rolf Baumgartel.
Washington County Assistant Prosecutor Jeremy Wolfe said his record was pretty significant.
“He was convicted of uttering and daytime robbery in 2000,” he said. “In 2004, he attempted a nighttime robbery and has spent close to a decade in prison.”
During the sentencing, Wolfe, Baumgartel and Russell declined to make a statement before the court.
Wolfe explained the robbery happened while Holbrooks-Mick’s parents were away from their home due to Holbrooks-Mick texting her parents beforehand to clarify that this would be the case.
“It’s a third-degree felony instead of a second-degree felony because people were not likely to be present,” said Wolfe. “They had texted to make sure.”
He said Russell and Christopher Wolfe entered the home by way of forced entry and stole various items throughout the house.
“They used an ax in the front yard to gain entry,” he explained.
Assistant Prosecutor Wolfe added the combined items were under $100.
“He stole some stuff including a container of change, some items around the house and a safe,” said Jeremy Wolfe. “I would say the damage to the front door will cost more than what they took.”
He explained the most concerning aspect was the crime was a home invasion.
“You lose some feeling of safety in a home invasion and no one should have to go through that,” he said.
He added Holbrooks-Mick will receive the same 24-month sentence today during her sentencing at 8:30 a.m. in Washington County Common Pleas Judge Randall Burnworth’s Court. According to Assistant Prosecutor Wolfe, Christopher Wolfe is in custody in Wood County and they don’t have court dates scheduled as of yet for Washington County.
Russell was sent to the Ohio Department of Rehabilitation and Correction Correctional Reception Center in Orient to be distributed to a prison from there.
