Waterford man arrested for sex crimes involving minor
The Washington County Sheriff’s Office arrested a Waterford man Friday and has charged him with sex crimes.
Michael Fortney, 23, of 375 Main St., Waterford, faces two charges: sexual battery, a third-degree felony, and unlawful sexual conduct with a minor, a fourth-degree felony.
According to Washington County Sheriff Larry Mincks, Fortney is incarcerated in the Washington County Jail.
Fortney will remain in custody, he confirmed, pending an appearance in Marietta Municipal Court before Judge Janet Dyar Welch.
“He was just arrested at about 5 p.m.,” said Mincks on Friday.
The sheriff said DNA was collected following a 15-year-old’s allegation against Fortney on July 20.
“We received a call from a lady in Waterford and her daughter, who is 15 years old, (she) was claiming that this guy, Michael Fortney, had had sex with her the night before,” said Mincks.
He said a rape kit was included in the investigation and Fortney denied the allegations.
“We did a rape kit, where they go to (Marietta Memorial Hospital) and do an examination and take swabs… and we also took a DNA sample from him and we sent all of that up to (the Ohio Bureau of Criminal Investigation),” said Mincks. “It came back today that it was a match.”
Mincks said a warrant was obtained Friday for the 23-year-old man and completed at Fortney’s home.
According to the Ohio Criminal Sentencing Commission, if a person is convicted of sexual battery, they may be sentenced for a term of up to life in prison. If convicted of either offense and sentenced to less than a life term, the sentencing commission’s December 2019 felony sentencing reference table indicates mandatory post-release control for five years.
In Washington County, post-release control is supervised by the Adult Parole Authority.
