The final defendant in the criminal case alleging attempted murder of Devon Ours did not appear before juvenile court for a hearing Wednesday.
Ours, of Marietta, is mending according to family members from injuries sustained during an alleged assault on Feb. 12.
Three individuals are accused of engaging in that attack with the two adults facing attempted murder charges amongst other felony indictments.
The third alleged assailant, according to the Washington County Sheriff's Office, is a minor who was scheduled to appear in Washington County Juvenile Court on Wednesday for a hearing to determine whether the 17-year-old would be tried as an adult alongside Steven Andrew Osborne, 19, of 529 Federal Road, Little Hocking; and Sierah Caldwell, 18, of 3719 Blue Knob Road, Apt. B, Marietta.
Osborne and Caldwell were arraigned on the felony counts in February.
The minor faces unknown charges related to the assault.
"The hearing did not happen today," confirmed Washington County Prosecutor Nicole Coil. "I can't give any details about what's going on because I don't want to create any wiggle room with the confidentiality policy regarding juvenile cases."
According to Juvenile and Probate Court Judge Tim Wiliams' docket, the hearing was rescheduled for next week.
At Osborne's Feb. 19 arraignment hearing before Washington County Common Pleas Judge Mark Kerenyi, the judge asked the intentions of the prosecutor concerning the three defendants.
"And my understanding of the juvenile, they're going to try to bind over as an adult," he asked.
In that hearing, Coil confirmed the intention to combine the three criminal cases.
Coil also noted Wednesday that no gag order was instated concerning Caldwell's case, following other outlets' reports in February.
"The motion ended up being withdrawn," she said. "There was discussion among counsel that we would refrain from talking to the media, so there was kind of an understanding that it wasn't necessary … I mean, I'm not going to hold back when I'm in court, but I'm not going to do anything to jeopardize the case."
