The jury trial for Oscar Hernandez Diaz for the murder of Abraham Olvero started in the Washington County Court of Common Pleas Monday morning with jury selection.
Oscar Hernandez Diaz, 42, and his brother Isaac Hernandez Diaz, 35, both of 300-A Dale St., Marietta, were arrested and charged in May 2022 with the murder of Olvero.
The two brothers lived at the Dale Street residence where a physical argument between Isaac Diaz and the victim Abraham Olvero's brother took place. When the two went back inside, Isaac armed himself with a wooden stake and Oscar armed himself with a katana-style sword.
The brothers returned to Olvera's apartment where he lived with his family. The two used their weapons to break into the apartment. Olvero was in front of the window when Oscar broke the window with the sword, and stabbed Olvero in the chest, according to Captain Aaron Nedeff, who was police chief at the time of the incident.
Isaac Diaz took a plea deal in February and pleaded guilty to attempted felonious assault for his involvement with the murder of Olvero. Per Isaac Diaz's plea agreement, he was sentenced to 12 months of prison unless trial testimony reveals different facts than previously known, according to Common Pleas Court officials.
Two groups of 80 potential jurors were summoned to court for the jury trial Monday morning, and one more group of 80 is being summoned this morning to determine the 12-person jury.
Oscar Diaz is represented by Defense Attorney Raymond Smith and Assistant Defense Attorney Hailey Murdock. Those forming the prosecution include Washington County Prosecuting Attorney Nicole Coil, Former Prosecutor James Schneider and Detective Allan Linscott with the Marietta Police Department.
