Oscar Hernandez Diaz trial ends in hung jury

A jury in the murder trial of Oscar Hernandez Diaz in Washington County Common Pleas Court Thursday said it was unable to reach a verdict.

After two days of deliberation, the jury entered the courtroom of Judge Mark Kerenyi around 5 p.m. Thursday after Kerenyi stated to the defense and prosecution he was going to present the jury with a Howard Charge, a standard jury instruction given to deadlocked juries. The charge reminds deadlocked jurors that their duty is to decide the case if they can conscientiously do so. After presented with the Howard Charge, the jury decided it was unable to reach a verdict in the amount of time they had received and that more evidence was needed.

Diaz remains in custody in lieu of bond. A date for another jury trial has not been set.
