More jail time for man released early on sex charge

A Lowell man who was granted judicial release in May 2019 is on his way back to jail.

Tylor Shayn Carpenter, 21, of 217 Fourth St., was sentenced Wednesday morning to 90 days in jail, minus credit for time served, for violating the terms of his judicial release.

Washington County Common Pleas Judge Mark Kerenyi said as soon as a bed is available at the STAR Community Justice Center in Franklin Furnace, Carpenter will be transported there for treatment.

Carpenter was arrested in July 2017 and charged with one count of rape, a first-degree felony, and sexual battery, a third-degree felony. He pleaded guilty in February 2018 to the sexual battery charge.

The arrest stemmed from a complaint of Carpenter having sex with a Marietta woman while she was passed out.

Washington County Assistant Prosecutor David Silwani said the state and Carpenter’s attorney, Ray Smith, agreed to send him to the treatment center.

“This recommendation to the court was discussed with Attorney (Ray) Smith as well as the adult parole authority. The defendant in this case came to his parole officer wanting help, so we think this is the best option available,” Silwani said. “He had a probation violation due to substance abuse.”

According to its website, STAR is a community based correctional facility intended to promote public safety and reduce prison commitments. Offenders participate in intensive cognitive-behavioral treatment in addition to educational, vocational and restorative activities during their stay of up to 180 days.

“This is an opportunity to show people you can learn,” Kerenyi told Carpenter, who said nothing on his own behalf.

Silwani said although Carpenter is going to STAR, he is still on judicial release.

“We’re not letting him off that,” he explained. “If he screws up, he can still go back to prison.”

Carpenter is listed as a Tier III sex offender and will be on the sex offender registry for life.

He was sentenced to 36 months in prison in April 2018, but only served 18 months before he was granted judicial release.
