A Marietta woman returned to Washington County Common Pleas Court on Wednesday in a continuation of a 2017 drug case.
Brittni Cheyenne Messick, 27, whose last known address was 460 Muskingum Drive, Marietta, was first arrested in February 2017 for possession of methamphetamine and had a previous charge for illegal conveyance of drugs into a government facility.
Messick pleaded guilty to aggravated possession of methamphetamine, a fifth-degree felony, and illegal conveyance of drugs, a third-degree felony, and was sentenced to one year of community control and treatment by Judge Mark Kerenyi under the supervision of the Adult Parole Authority.
Messick's sentence included treatment at the Oriana House correctional facility in Reno.
But in November 2017, according to court documents, she violated her plea agreement..
On Wednesday, Messick appeared via teleconference to account for those violations before the judge.
When asked if she had a statement before the court, Messick declined to speak but during her sentencing hearing in 2017, she said she would "shape up" in order to be with her daughter.
"I'm just ready to get this done and over with so I can get to rehab and get my life back together," said Messick in 2017.
Although given the opportunity for treatment, Messick did not comply, Assistant Prosecutor Joe Derkin said following the hearing.
"We had tried treatment multiple times and she didn't take it seriously, nor her supervision," he said.
In that 2017 filing, six violations are documented, as reported by her parole officer Lauren Wheeler.
Wheeler reported:
¯ Messick used heroin in October 2017.
¯ She had an instrument for administering drugs on her person.
¯ She was fired from her job at the Lafayette Hotel and did not inform Wheeler.
¯ She also did not acquire permission from Wheeler before changing her residency,
¯ Messick was in contact with law enforcement and did not inform Wheeler.
¯ Messick did not report to Wheeler as was required.
As a result of the filing, Messick's case was reopened and she was then arrested and held without bond in May 2018.
She was sentenced to serve in the Ohio Reformatory for Women for eight months for the possession of controlled substance charge and 30 months for the illegal conveyance charge to be served concurrently.
Appearing before Washington County Common Pleas Court in November 2018, Messick filed a motion for judicial release which was withdrawn in January 2019.
Messick will continue to serve the remainder of her 30-month sentence at the Ohio Reformatory for Women in Marysville with about 13 months left to serve.
"She could only get the original sentence," Public Defender Ray Smith said following Wednesday's hearing. "She filed (for) judicial release, the judge didn't have the power to give her more, that's all he could give her. He gave her everything he could give her."
