A juvenile who was involved in the beating of Marietta resident Devon Ours was indicted this week by the Washington County Grand Jury.
Isaiah Campbell, 17, of 5665 Veto Road, Belpre, was indicted on one count of the first-degree felony attempted murder and will be tried as an adult.
Washington County Prosecutor Nicole Coil said Juvenile Court Judge Tim Williams held a hearing to determine if there was probable cause for the complaint alleging the teen was delinquent for committing attempted murder.
"If probable cause is found and the juvenile is 16 or 17 years of age, it is mandatory that the case be transferred to the court of common pleas," Coil said. "That is what happened in this case."
She said if the juvenile is charged with being delinquent for committing a felony of a lesser degree, the transfer would not be mandatory, but discretionary.
"The court would look at multiple factors to decide if it should transfer the case or retain jurisdiction," she noted. "Only an attempted murder was included in the juvenile complaint, and that was the only charge which was bound over to the (court of common pleas)."
The maximum sentence for attempted murder is a life sentence. He could be eligible for parole if convicted.
According to the Washington County Sheriff's Office, on Feb. 12, a 911 call was received requesting assistance in regards to an unresponsive man suffering from a head wound.
Deputies responded to 3719 Blue Knob Road, Apt. B, Marietta, and found Ours lying on the floor, bleeding from a head wound. During the investigation, it was found that Ours had been punched, kneed in the head and hit with a baseball bat.
The assailant, Steven Andrew Osborne, 19, of 529 Federal Road, Little Hocking, was indicted along with his girlfriend, Sierah Caldwell, 18, of 3719 Blue Knob Road, Apt. B, Marietta, on multiple charges, including attempted murder, felonious assault, and tampering with evidence.
Osborne's defense attorney, George Cosenza, entered a not guilty by reason of insanity plea.
Coil said Ours is no longer at Marietta Memorial Hospital, but at another facility, but his condition is improving.
