Two plead guilty to assault charges, sexual battery
Two Washington County men pleaded guilty to sexual battery and malicious assault charges before Judge Mark Kerenyi in common pleas court Friday morning.
Charles L. Augenstein, 68, 26935 State Route 7 Apt. 4B, Marietta, was indicted by a grand jury last August on charges of sexual battery and rape after he engaged in sexual activity with a female family member, according to assistant prosecutor Kelsey Riffle.
Through a plea agreement, Augenstein pleaded guilty to sexual battery and faces a maximum sentence of 60 months. Per the plea agreement, he is to register as a tier three sex offender and the rape charge was dismissed, according to Kerenyi.
The sexual encounters happened from May 1, 2021, to June 28, 2021, which involved intercourse. Riffle said Augenstein admitted to the acts in front of an officer.
According to the indictment, the victim’s ability to resist was “substantially impaired because of a mental or physical condition and (Augenstein) knew or had reasonable cause to believe (the victim’s) ability to resist or consent was substantially impaired.”
Andrew C. Rowland, 38, 751 Luke Chute Road, Waterford, pleaded guilty to felonious assault after he stabbed a woman on August 3, 2021. He was indicted by a grand jury last September on charges of attempted murder, two counts of felonious assault and domestic violence.
Riffle said Rowland went into a bar and stabbed the victim twice, which was partially caught on video.
Rowland pleaded guilty to felonious assaulted and per the pleas agreement, the charges of attempted murder, one count of felonious assault and domestic violence were dismissed. The court will set a minimum sentence of two, three, four or five years plus 50 percent, which would total to eight and a half years.
In both cases, a pre-sentence investigation will be conducted which will include a victim impact statement. Augenstein will be sentenced April 4 at 8:30 a.m. and Rowland will be sentenced April 8 at 8:30 a.m. in Kerenyi’s court.
