Hickman trial continues into day seven

The trial of Scott Hickman in a 1995 double murder of a mother and son completed its seventh day Thursday.

Hickman was indicted in 2021 on four counts of aggravated murder and two counts of murder in the killings of Kimberly Fulton, 28, and her 17-month-old son Daniel.

Previous testimony indicated investigators believe the murders were committed by more than one suspect who had smothered the victims before pouring gasoline over them and setting the mobile home on fire during the early morning of March 5, 1995.

The trial began last week and resumed Tuesday before Washington County Common Pleas Court Judge Mark Kerenyi. Five of the six remaining witnesses for the prosecution – handled by the Special Prosecutors Section of the Ohio Attorney General’s office – testified Thursday. They included crime investigators, Hickman’s cellmates and his ex-girlfriend.

The prosecution presented the jury with a 95-minute deposition of the defendant’s ex-girlfriend Mary Francis, who was allegedly dating him during the time of the murders and continued seeing him up until December 1995.

“He told me to stay on his left side because his right side was evil,” said Francis.

The video began with questions from the prosecution about how Hickman’s demeanor was before and after the fire on March 5. She also answered questions about how Hickman was related to others involved in the case.

Francis said Daniel’s biological father was a friend of Hickman, another man arrested last year in connection with the case and Fulton’s ex-husband.

In the deposition, Francis initially said Hickman had not been with her early the night before the murder. Hickman’s attorney reminded her that her statement in a 1995 interview indicated he was, contradicting an initial alibi. Francis said the original statement was correct and noted “this was 30 years ago” and she’s been through a lot since then.

Washington County Sheriff’s Office Detective Bruce Schuck walked through a plethora of documents that revealed the timeline of Kimberly Fulton’s divorce in 1994 as well as child support papers between her and Daniel’s biological father in 1995.

“(He) was having extramarital affairs with Kim, and he had impregnated her and wanted her to have an abortion,” said Schuck. “She wanted (him) as the father and was asking him for financial support.”

Documents from Washington County Child Support Enforcement Agency had evidence of DNA testing which revealed a 99.15% match that the other man was Daniel’s biological father.

Schuck also described the court documents for a child support hearing date that was scheduled on March 30, 1995 between the man and Kimberly.

“He wanted excused from paying any child support even after their deaths,” said Schuck.

Schuck said that Hickman was close to Daniel’s father and they and the third man lived within two miles of Kimberly’s mobile home.

“His (Hickman’s) association with (the father) and the fact that he was discussing information about the crime scene that wasn’t public information,” said Schuck as an explanation of why Hickman was a suspect.

Two former cellmates of Hickman’s in 2021 described being in jail with Hickman and said he had “no remorse.”

The trial is scheduled to continue at 9 a.m. today.
