Grand jury accuses man of abusing baby

A man accused of beating his 3-month-old child severely enough to break several bones and cutting the child’s tongue was among 28 people indicted by the September sitting of the Washington County grand jury. The indictments were announced Wednesday by prosecutors.

On Aug. 29, Kyle M. Williams and the mother of his 3-month-old boy arrived at Marietta Memorial Hospital requesting treatment for the baby, who was suffering from numerous broken bones and a laceration in his tongue, said Washington County Assistant Prosecutor Joe Derkin. The doctor recognized signs of child abuse and called Children Services.

Williams, 19, whose residence was given as 1101 Cisler Lane in Marietta, does not have a criminal record, Derkin said, and there was no indication that drugs or intoxication was involved. He was arrested and remains in the Washington County Jail, charged with two counts of child endangering and three counts of felonious assault, all second-degree felonies, and one count of domestic violence, a fourth-degree misdemeanor.

His arraignment was set for 8 a.m. today.

The child is in the custody of the state child protective services agency, Derkin said, because the mother was not deemed a qualified custodian. The mother, he said, is not facing charges at this time.

Because the investigation is in progress, a detailed incident report was not available from the Washington County Sheriff’s Office.

Other indictments

Other indictments included three counts of rape and one count of kidnapping, all first-degree felonies, charged against Craig Burkheimer of Reno.

Burkheimer, 23, is accused of raping a child under 10 years of age, a child under 13 years of age, a child of 13, and detaining the child against the child’s will, said Washington County Assistant Prosecutor Rhonda Mears. Mears said the charges all involved one victim. A relative of the victim reported the accusations after the victim disclosed the details, prompted by the discovery of an “item of a sexual nature” in the victim’s backpack, Mears said.

Burkheimer is in the Washington County Jail in lieu of $500,000 bond, Mears said, and a trial is expected in early November.

≤ Joseph E. Carter, Jr., 27, of 30762 County Road 59, Lower Salem, was indicted on two counts of aggravated vehicular homicide, third-degree felonies. On May 11, Carter was traveling in a work van in the direction of Marietta on Ohio 60 when his vehicle crossed the center line and collided with a Saturn sedan, said Washington County Prosecutor Kevin Rings. The driver and passenger in the Saturn – Jimmy Conway, 64, and his wife, Bonnie Conway, 59, both of Malta – were killed in the crash, Rings said.

≤ Christy L. Biehl, 36, of 16040 Sealy Ridge Road in Vincent, and David Longwell, whose address was given as the Washington County Jail, were indicted as co-defendents on charges of grand theft, possessing criminal tools, breaking and entering and theft in connection with a break-in on Blue Knob Road in Washington County on Sept. 1, Derkin said.

“They broke into the house and ransacked it, stealing guns and other items,” he said. The two were boyfriend and girlfriend and have a child in common, he said. The night of the theft, he said, the homeowner saw them and blocked their escape by parking his vehicle across the driveway; the two fled on foot but were captured, Derkins said. The two were also indicted in connection with a theft that occurred last October in the 14000 block of Ohio 550 which included taking the family Bible, Derkin said.

In all, Biehl is facing one count each of grand theft – which involved firearms and is a third-degree felony – possessing criminal tools, a fifth-degree felony, breaking and entering, a fifth-degree felony, two counts of burglary, a second-degree felony, and two counts of theft, a first-degree misdemeanor. Longwell, 43, is charged with one count each of grand theft, possessing criminal tools, breaking and entering and burglary, and two counts of theft. Longwell is jailed in lieu of $50,000 bond, Derkin said, and Biehl also is in jail, and bond information for her was not available.

≤ Tylor S. Carpenter, 19, of 223 Greene St., Apt. 3, Marietta, was charged with one count of sexual battery, a third-degree felony, and one count of rape, a first-degree felony. Mears said the charges involved sexual conduct with someone who was substantially impaired, unable to resist or impaired because of a mental or physical condition.

≤ Izaak N. Morris, 20, last known address 89 Thorn St., Parkersburg, was indicted on one count of grand theft of a motor vehicle and one count of theft of drugs, both fourth-degree felonies. Morris is alleged to have stolen a car in Belpre while going from one vehicle to another looking for property to steal. He found a car with the keys in it, Rings said, and drive it over to Parkersburg, where he continued seeking theft-from-vehicle opportunities. Morris is currently in prison in West Virginia, Rings said.

≤ Brian R,. Mincks, 36, of 720 Ruble Ave., Belpre, was indicted on one count of drug trafficking and one count of drug possession, both fourth-degree felonies.

≤ Nathan C. Strickler, 30, of 1454 Rector Road, Parkersburg, was indicted on allegations of receiving stolen property, a fourth-degree felony, in connection to the theft of blank checks from two Belpre residents.

≤ Pamela L. Bates, 33, of 1612 N. McAllister Ave., Tempe, Ariz., was indicted on charges of assaulting a corrections officer, a fourth-degree felony, in connection with an incident at the Washington County Jail.

≤ Joey D. Brooks of 316½ Harmar St., Marietta, was indicted on one count of grand theft of a firearm, a third-degree felony, and burglary, a second-degree felony, in connection to the theft of a Remington 870 12-gauge shotgun from the home of a neighbor who, Rings said, captured the event on video.

≤ Cameron L. Bell, 23, of 5220 Stonebridge Court, Solon, was indicted on one count of possession of cocaine, a fifth-degree felony. Bell was stopped by Ohio State Patrol in Salem Township on Dec. 8, Rings said, after a trooper found cocaine in his vehicle.

≤ David W. Wriston, 33, of 683 Wynncrest Drive, Marietta, was indicted on one count of drug possession, a fifth-degree felony.

≤ Terry L. Maples, 54, of 811 Third St., Marietta, was indicted on one count of improperly handling firearms in a vehicle, a fourth-degree felony, and one count of disorderly conduct, a minor misdemeanor. Rings said Maples encountered another person with whom he had an ongoing dispute when they passed one another on the road and got into an argument. A loaded handgun in Maples’ vehicle was not correctly secured, Riggs said. He did not know whether Maples threatened the other person with the gun.

≤ Stephen P. Anderson, 59, of 1611 Andrew St., Parkersburg, was indicted on one count of possession of heroin, a fifth-degree felony.

≤ Russell C. Beardsley, 43, of 210 Upper Fifteen Mile Road, Wingett Run, was indicted on one count of possession of drugs, a fifth-degree felony, and one count of possession of drug abuse instruments, a first-degree misdemeanor.

≤ McKenzie A. Cowan, 24, of 814 Seneca Drive in Belpre, was indicted on one count of aggravated possession of drugs, a fifth-degree felony.

≤ Cherrish N. Harmon, 22, last known address 6735 County Road 37, Tuskegee, Ala., was indicted on one count of escape from custody, a third-degree felony. Harmon was convicted of breaking and entering but failed to appear in court, the prosecutor’s office said, and her last known location was in South Carolina.

≤ Austin L. Lightfritz, 19, of 116 Harmar St., Marietta, was indicted on one count of grand theft of a motor vehicle, a fourth-degree felony, and one count of unauthorized use of a motor vehicle, a first-degree misdemeanor. In January Lightfritz arranged to test drive a car for sale by a private owner, drove it away and didn’t return, prosecutors said. He was found with the car, a 1998 Toyota Avalon, 16 hours later by Marietta police.

≤ Corey L. Smearman, 29, of 910 Fourth St., Marietta, was indicted on one count each of possessing criminal tools, a fourth-degree felony, aggravated trafficking in drugs, a third-degree felony, aggravated possession of drugs, a fifth-degree felony, and possession of heroin, a fifth-degree felony.

≤ Bryan J. Williams, 35, of 2908 Sealy Ridge Road, Vincent, was indicted on one count each of felonious assault, a second-degree felony, and domestic violence, a fourth-degree misdemeanor. Williams is alleged to have “kicked his girlfriend hard enough to break her ribs,” Derkin said.

≤ Randy J. Clevinger, 30, of 2265 Tick Ridge Road, Lower Salem, was indicted on one count of domestic violence, a third-degree felony, on allegations that he chased his father with a bat and threatened to kill him, Rings said. No assault occurred, he said, and Clevinger has several prior domestic violence convictions.

≤ Douglas E. Mitchell, 28, of 702 31st St., Vienna, was indicted on three counts of rape, a first-degree felony, on allegations that he had sexual relations with a male under 13 years of age. Derkin said Mitchell was arraigned Wednesday, with bail set at $100,000 and a trial date set for Nov. 20.

≤ Brian K. Mayle, 34, of 39 Burr St., Clarksburg, W.Va., was indicted on one count of receiving stolen property, a fifth-degree felony.

≤ Carl Claypool, 33, of 316 Pennsylvania Ave., Nutter Fort, W.Va., was indicted on one count of receiving stolen property, a fifth-degree felony.

≤ Lisa Runnion, 22, last known address 307 Maple St., Marietta, was indicted on one count of failure to appear, a fourth-degree felony. Derkin said Runnion failed to attend a final pretrial hearing in connection to a robbery.

≤ Shandi Hamrick, 29, of 721 Ohio Ave., Belpre, was indicted on one count of breach of recognizance.

≤ Mark Smith, 27, of 1030 George St., Parkersburg, was indicted on one count each of receiving stolen property and theft, both fifth-degree felonies.

≤ Josh Martin, 37, of 240 Hillcrest, Apt. 71, Marietta, was indicted on one count of domestic violence, a third-degree felony. Rings said Martin has two or more previous domestic violence convictions.

Possible prison terms, maximum fines

First-degree felony: Three to 11 years; $20,000.

Second-degree felony: Two to eight years; $15,000.

Third-degree felony: One to three years; $10,000.

Fourth-degree felony: Six to 18 months; $5,000.

Fifth-degree felony: Six months to one year; $2,500.
