Grand Jury indicts 17 people
A Belpre man was indicted again this week by the Washington County Grand Jury on six counts including felonious assault and assault.
Terry “Brian” Fox, 47, of 312 Walnut St., was indicted in May on one count of felonious assault, a second-degree felony; one count of assault, a fourth-degree felony; one count of failure to comply with an order or signal of a police officer, a third-degree felony; one count of criminal trespass, a fourth-degree misdemeanor; one count of theft, a first-degree misdemeanor; and one count of obstructing official business, a second-degree misdemeanor.
Washington County Prosecutor Nicole Coil said the felonious assault charge was increased to a first-degree felony because the victim was a peace officer.
“We could have done it the first time,” she said. “We thought maybe it could be resolved.”
She said she didn’t want to charge him unnecessarily high the first time, but Fox “doesn’t seem to want to resolve it.”
Coil said that was the reason the charge was increased from a second- to first-degree felony.
“We’re going with all the potential charges,” she said.
According to Washington County Sheriff’s Office reports, deputies responded in January to Briggs Sand & Gravel Inc., Blue Knob Road, Warren Township. A witness reported subjects may be stealing from the business as there was a vehicle parked on the property. When the vehicle left, it almost hit the caller’s car and the caller reported the incident as they continued to follow the vehicle.
A sergeant responded to the area where the subject was last seen, noted the report. As the sergeant was nearing an intersection, the suspect vehicle was approaching him. The report states he slowed, still utilizing his siren and lights, when the suspect vehicle continued driving toward the patrol vehicle. The suspect vehicle showed no signs of slowing and when passing the sergeant, struck the patrol vehicle on the driver side.
The sergeant reportedly began to pursue the subject(s), and observed the vehicle over a hill in a field. Other deputies arrived on scene and approached the vehicle.
A search of the area began with deputies locating Ryan O. Nichols, 45, of 1936 Barth Road, Belpre, hiding under leaves in the woods, according to the sheriff’s office. Nichols was taken into custody and placed in the patrol vehicle. Nichols stated he did not know the other subject.
Deputies reportedly inspected the original crime scene at Briggs Sand & Gravel and found the fuel cap removed and diesel fuel was spilled on the ground. Deputies obtained the identity of the other man as Terry Brian Fox.
Other indictments include:
¯ Kevin A. Morris, 38, of 460 Barrett South Road, Vincent, was indicted on one count of pandering sexually-oriented matter involving a minor or impaired person, a second-degree felony, and one count of pandering sexually-oriented matter involving a minor or impaired person, a fourth-degree felony. According to the indictment’s count one, Morris allegedly created or reproduced material that shows a minor participating in sexual acts. In the second count, Morris reportedly received, possessed or controlled material showing a minor participating in sexual activity.
¯ Heather D. Thompson, 33, of 112 Knox St. Apt. 23, Marietta, was indicted on one count of permitting drug abuse, a fifth-degree felony. She allegedly allowed Mageed V. Dunor to traffick drugs out of her residence in June 2021.
¯ Mageed V. Dunor, 26, of 3576 Astor Ave., Columbus, was indicted on one count of trafficking in a fentanyl-related compound and possession of a fentanyl-related compound, both third-degree felonies. He allegedly had between five and 10 grams of the fentanyl compound for sale in June 2021 at the residence of Heather D. Thompson in Marietta.
¯ Donta Eugene Allen, 40, of Marietta, was indicted on one count of felonious assault, a second-degree felony, and one count of domestic violence, a fourth-degree felony. He allegedly caused serious harm to a family member in June. He had previously been convicted of domestic assault with bodily injury in April 2012 in Criminal Court, Nashville, Tenn.
¯ Jonathan C. Forshey, 31, homeless, also known as Jonathan Michael Deem, was indicted on one count of having weapons while under disability, a third-degree felony, and one count of possessing a defaced firearm, a first-degree misdemeanor. He was reportedly found with a firearm in April at 40 Acme St., Marietta. The firearm allegedly had a mark of identification changed or removed.
¯ Tiffanie A. Keyes, 37, of 224 Daisy Lane, Ravenswood, was indicted on one count of aggravated possession of drugs, a fifth-degree felony, and one count of possession of drugs, a first-degree misdemeanor. She was reportedly found with methamphetamine and buprenorphine at the 400 block of Greene Street in September 2019.
¯ Clarence M. Francis, 32, of 1779 Masonic Park Road, Marietta, was indicted on one count of tampering with evidence, a third-degree felony. He allegedly altered or destroyed documents with purpose to impair its value or availability as evidence.
¯ Caleb Bruce Jordan Burkett, 25, of 60 Young Road, Marietta, was indicted on one count of aggravated possession of drugs, a fifth-degree felony. He was allegedly found with methamphetamine in December at the 800 block of Pike Street, Marietta.
¯ Matthew T. Sandy, 39, of 2090 County Road 9, Marietta, was indicted on one count of failure to appear as required by recognizance, a fourth-degree felony, and one count of violating a protection order, a first-degree misdemeanor. He reportedly failed to appear in the Washington County Court of Common Pleas on June 8. He also allegedly violated a protection order from Jan. 27 through June 8.
¯ Daulton S. Self, 34, of 809 Brentwood Drive, Belpre, was indicted on one count of failure to appear as required by recognizance, a fourth-degree felony. He reportedly failed to appear in the court of common pleas on June 27.
¯ John Wayne Bartlett, 37, of Marietta, was indicted on one count of domestic violence, a fifth-degree felony. He allegedly caused harm to a family member in May.
¯ Brandon M. Young, 29, of 29 Johnson Road, The Plains, was indicted on two counts of theft, both fifth-degree felonies. He allegedly stole $1,617.06 from one victim, and $1,618 from a second victim.
¯ Amanda N. Spence, 25, of 3843 W. 41st St., Cleveland, and Sidney J. Walker Jr., 48, of 2999 Continental Colony Parkway, Atlanta, Ga. were indicted after being found with a fentanyl-related compound and cocaine at 700 Pike St., Marietta, in December. Spence was indicted on one count of possession of a fentanyl-related compound, a third-degree felony, and one count of possession of cocaine, a fifth-degree felony. Walker was indicted on one count of trafficking in a fentanyl-related compound and one count of possession of a fentanyl-related compound, both third-degree felonies; and one count of possession of cocaine, a fifth-degree felony.
¯ Alec L. Davis, 24, homeless, was indicted on one count of assault, a fourth-degree felony; one count of resisting arrest, a second-degree misdemeanor; and one count of criminal trespass, a fourth-degree misdemeanor. In May, he allegedly assaulted a peace officer while resisting arrest at the Super 8 Motel in Marietta.
¯ Anthony Michael Biggs, 30, of 33 Daisy Drive, Proctorville, was indicted on one count of escape, a third-degree felony. He allegedly did not return to detention at 27830 State Route 7, Marietta, on May 17.
¯ Steven David Starling, 48, of 110 Elm St., Belpre, was indicted on two counts of menacing by stalking, both fourth-degree felonies. He reportedly threatened two individuals and made them believe he would cause them physical harm through May 2021 through April.
